Preambule
Maison Artaner Paris creates, designs and sells items of jewellery and fashion accessories on French and International markets. All our pieces are crafted in our Parisian workshop.
www.artanerparis.com ("hereinafter the online store") is administrated by Maison Artaner Paris SAS with a capital of five thousand euros. Our head office is located at 46, rue de Paradis 75010 Paris, France and registered at the Paris Trade and Companies Register under number 823172622, intra-community VAT number FR 19 823 172622.
These General Conditions of Sale are intended to define the rules applicable in the context of the purchase of items sold by SAS Maison Artaner Paris (hereinafter “the items”) on the online store. www.artanerparis.com and the Client. A “Client” is any individual (and not legal entity) who has reached the age of majority and who acquires the items(s) for his/her personal use (and not for distribution or resale).
Access to sales through the online store www.artanerparis.com is exclusively reserved for Customers living in deliverable countries: www.artanerparis.com
These Terms of Use govern the use of the Maison Artaner Paris website and mobile application (together the “Platforms”).
In these Terms of Use, we use the term Maison Artaner Paris (and " we", "us" and "our") to refer to the Maison Artaner Paris’s head office (at the registered address above) and its affiliates.
Article.1 Application of the general Terms of Use
These general conditions of sale apply, without restriction or reservation, to all orders and services offered by Artaner Paris and placed by any adult natural person on the online shop www.artanerparis.com
Any order on the online store www.artanerparis.com is subject to a prior, unconditional acceptance by the Customer of the GTC (General Conditions of Sale) and the applicable prices. The act of placing an order on the online store www.artanerparis.com constitutes acceptance of these general conditions of sale.
Thus, the Customer recognises and accepts that the proof of acceptance of these general conditions of sale is characterised by checking the words "I have read and I accept the General Conditions of Sale".
Artaner Paris reserves the right to modify these General Conditions of Sale at any time.
The General Conditions of Sale applicable to the specific order placed by the Customer on the online store www.artanerparis.com are those accepted by the Customer at the time the order was placed.
UPDATES TO THESE CONDITIONS OF SALE
Artaner Paris may modify the Terms of Use from time to time. Please check the website regularly to be informed of any updates. The latest version of the Terms of Use will always be available on the Platform. Any new version of the Terms of Use shall take effect, and will govern the use of the Platform and your relationship with us, immediately upon the date of publishing. By continuing to use the Platform, you indicate your agreement to be bound by the terms of these updates and amendments.
Article.2 Product descriptions and availability
2.1 Product availability
Photographs of the items created by Artaner Paris are available on the online store www.artanerparis.com
The essential characteristics of these Items are presented with the greatest possible accuracy on the online store www.artanerparis.com
However, colours of the Items may vary in accuracy, depending on the internet browser and screen used.
Likewise, all fine and precious stones are by nature never identical, stones may differ slightly to the photographs. Errors or omissions may occur. Artaner Paris cannot make guarantees in relation to the accuracy or reliability of the descriptions.

Article 3 Orders
3.1 Creating an account
Any order placed on the www.artanerparis.com online store is subject to compliance with the procedure in place designed by Artaner Paris.
The Customer has the obligation to follow the given procedure so that the order can be processed.
Thus, for any order, the Customer is asked to create an account with accurate and up-to-date personal information.
In the event of an error in the wording of the recipient's contact details, Maison Artaner Paris cannot be held responsible for the inability to deliver the item.The Customer must also choose an e-mail address and a password which will be requested to login to the account.
The Customer's personal information is thus protected by a password so that the Customer alone has access to it.
Maison Artaner Paris recommends that the Client does not disclose it to anyone.
The Customer must also disconnect from his or her account and close the browser window at the end of each connection. This way, the Customer will prevent users from accessing personal information.
The Customer is solely responsible for ensuring that the password and account login are kept secret. The Customer shall solely bear the consequences of any fraudulent use of the password
3.2 Confirmation of the order
The Customer must check the details and price of the order before placing it.
Once your order has been placed on the Platform, you will receive an Acknowledgment of Order by email, acknowledging the details of your order. Les commandes spéciales (demi-mesure, grande mesure, sur-mesure) ne sont ni échangeables ni remboursables The contrat is formed upon receipt of the deposit.
Artaner Paris cannot be held accountable for entry errors made by the Customer that prevent delivery of the confirmation email. However, the Customer may contact Artaner Paris directly via email: contact@artanerparis.com for more information on the order.
The sale will only be considered final after receipt of payment in full. Artaner Paris will then send the customer an order confirmation email, specifying the delivery date.
The customer must carefully check and confirm all details on the payment page before placing the order through the Platform, including, without limitation, the details for each sale. In the case of an order being placed through the Customer Service Centre, the Maison Artaner Paris Ambassador may verbally ask the customer to confirm the details of the order.
Artaner Paris reserves the right to refuse any Order from a Customer with whom a dispute exists or appears during the processing of an order, especially a payment dispute. This applies to any order presenting a fraudulent nature.
3.3 Special orders
Artaner Paris is pleased to provide the Customer with a personalised service dedicated to the customisation of their products, via the e-mail address: contact@artanerparis.com
Thus, for all tailor-made orders, Artaner Paris will issue a quote, valid for 30 days from the day of its issuing.
Changes will only be made once accepted by the Customer.
For personalised or made-to-measure items, the delivery date will be indicated in the quote sent to the customer.
The services offered for personalisation are: Engraving on a ring or bracelet, once Sizing Ring, Bracelet or Necklace, Custom-made creations of any kind (Engagement ring, Wedding Ring ...)
In accordance with the provisions of Article L221-28 of the Commercial Code, tailor-made items created by Artaner Paris cannot be returned or exchanged because of the personalisation.
Consequently, the withdrawal period (Articles 7 of these General Terms and Conditions of Sale) is not applicable to personalised items.
Special orders (Half-mesure, made-to-measure) are neither exchangeable nor refundable. The contract is formed upon receipt of the deposit.
The prices displayed on the online store are indicated in euros, all French taxes included (French VAT and other taxes that may be applicable on the day of the order, unless otherwise indicated).
For any order outside the European Union, the price of the item (s) is indicated excluding French VAT to which will be added to the transportation costs, local customs taxes and other taxes.
The prices can be modified at any time, without notice and especially in the event of change of tax data. The items (s) will be invoiced on the basis of the rates in effect at the time the order is placed.
Article 5. Terms of Payment
Payment for orders on the www.artanerparis.com online store can be made :
Via PAYPALCB, MasterCard®, Visa®, American Express®.
Cards issued by banks based outside France must be international bank cards as indicated (Visa, MasterCard, American express).
5.1 Secure Payments
In order to strengthen the security of online payment, Artaner Paris has set up secure payment with 3D Secure implemented by our partner : Société Générale.
The Customer must provide on placing the order, information relating to his bank card (in particular the card number, the date of validity and the cryptogram on the back of the card).
Bank data (bank card numbers) are transmitted encrypted directly to the bank and are not stored at any time on the online store www.artanerparis.com
Payment is the last step in confirming the order. The Customer may modify the details of the order at any time, until validation of the payment. As specified in Article 3, the sale will be considered final only after receipt of payment in full.
Article.6 Delivery and guarantee of conformity
Deliveries are secure and provided by the two partners Colissimo and Fedex. Delivery times depend on the delivery location.
6.1 Delivery time
For all deliveries in mainland France and the European Union, the delivery time is 15 working days.
For any delivery outside Europe, the delivery time is 20 working days from the confirmation of the order.
6.2 Delivery rates and deliverable countries

6.3 General
The Customer is required to provide all the information necessary to ensure a smooth delivery process. (Name, full address, floor, staircase, access code)
6.4 Transfer of responsibility
Artaner Paris ensures the transport of the items until delivery, when the customer takes physical possession of the Items and when the responsibility for the purchased items falls to the Customer according to the French Consumer Code L.138-4.
6.5 Customs duties
For all orders outside the European Union, transport to the point of delivery is the responsibility of Artaner Paris. The sale is made when "delivered to the destination" .
The Customer must inquire with the competent authorities of the country concerning import or local taxes applicable to the order. It is understood that customs taxes and import duties are the sole responsibility of the Customer, unless otherwise indicated.
Artaner Paris is unable to verify applicable customs duties and taxes.
It is understood that for security reasons, the delivery of Artaner Paris Creations is made only against the signature of an adult, confirming receipt of the items.
It is also understood that delivery can only take place at the Customer's permanent home address and that no delivery can be made to hotels or PO boxes.
However, the Customer has the option of having the items (s) delivered to one a natural persons of his or her choice and whose permanent address is located in mainland France (including Corsica) or on the list of deliverable countries.
In order to best ensure the Customer's order, delivery will be sent in unmarked packaging to the address associated with the order.
6.6 Guarantee of conformity
Without prejudice to the withdrawal period provided for in Article. 7 upon receipt, if the package is damaged or opened, the Customer may refuse delivery by specifying the reason on the transport voucher, or else, accept it by detailing specific reservations on the transport voucher (e.g. photo). Any delivery of packages accepted without reservation on delivery will be deemed to be free from any defect.
In the event that the Items delivered do not comply with the order, the Customer must inform Artaner Paris within 48 hours by e-mail contact@artanerparis.com and return the Items in question under the conditions set out in the 'Article 7 of these General Conditions of Sale’, at the following address: Maison Artaner Paris, 46, rue de Paradis 75010 Paris France.
Upon receipt of the return request, and subject to acceptance, Maison Artaner Paris will send a return slip by e-mail, which must be included in the returning package.
The refund for the costs of return and delivery of non-conforming items will be made to the Customer's bank account after the Customer has sent proof of said costs.
6.7 Delivery tracking
The Customer will be able to follow the delivery of the order, thanks to an online tracking number, issued via email after the order is placed.
Article.7 Withdrawal period
In accordance with Article 121-21 of the Consumer Code, the Customer has a period of 14 days from receipt of the delivery to exercise his or her right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs.
This period starts upon receipt of the order.
In order to exercise a right of withdrawal, the Customer must make a return or exchange request by e-mail to contact@artanerparis.com.The returned Item (s) must be sent to the following address only: Maison Artaner Paris at 46, rue de Paradis 75010 Paris France.
7.1 How to exercise a right of withdrawal
Artaner Paris Creations must be returned in new and unused condition in their original packaging, including the warranty certificate, invoice and boxes.
It is specified that any item returned incomplete, spoiled, damaged, soiled or worn will, in no case, be returnable.
It is understood that the Customer must keep proof of this return, which means that the Items must be returned by registered mail. The shipping must be insured by the customer and the customer must send a tracking number to Maison Artaner Paris.
The costs and risks of return remain the sole responsibility of the Customer. Artaner Paris, will not pay any additional shipping costs.
Upon receipt, and after verification, Artaner Paris will refund the purchase amount using the same payment method used by the Customer at the time of the initial transaction.
Considering the value and the amount, the refund will be made within 25 days.
It is understood that for any return or exchange outside the European Union, the Customer must clearly indicate on the customs clearance packing slip that this is a non-commercial shipment to avoid payment of customs duty upon delivery.
In the event of an exchange, Artaner Paris will do the same to avoid a second payment of customs duty, payable by the Customer.
Article.8 Guarantee against defects and hidden defects
Artaner Paris rigorously applies the legislation in force concerning product defects and hidden defects, under the conditions provided for in articles L.211-4 to L.211-13 of the French Consumer Code and articles 1641 to 1648 and 2232 of the French Civil Code.
The Artaner Paris items are created in compliance with current French legislation.
The guarantee against defects and hidden defects cannot be engaged in the following cases:
In the event of abnormal or improper use, in the event of normal wear and tear of the Product, accident or force majeure.
However, the guarantee will not hold in the event of intervention by an unauthorized third party on the product.
The legal provisions relating to the guarantees from which the Customer benefits are reproduced below.
Article L. 211-4 of the Consumer Code: The seller is required to deliver goods in accordance with the contract and is liable for any lack of conformity at the time of delivery. The seller is also responsible for any defect resulting from the packaging, the assembly instructions or the installation when this has been charged to it by the contract or has been carried out under its responsibility.
Article L. 211-5 of the French Consumer Code: To comply with the contract, the goods must:
1 ° Be suitable for the use usually expected of a similar good and, where applicable:
Correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model.
Present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
2 ° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L. 211-12 of the Consumer Code: Action resulting from lack of conformity lapses two years after delivery of the goods.
Article 1641 of the Civil Code: The seller is bound by the guarantee for the hidden defects of the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price, had he or she known.
Article 1648 paragraph 1 of the Civil Code: The action resulting from latent defects must be brought by the buyer, within two years from the discovery of the defect.
Article.9 Guarantee in case of breakage
If an Items is scratched or broken and if this is the result of an incident that is not the consequence of defects or hidden defects, Artaner Paris can issue a quote to the Customer for repairs.
The repair will be carried out if the estimate is accepted and the payment made.

Article.10 Intellectual property
Maison Artaner Paris remains the owner of all intellectual property rights on the photographs, presentations, studies, drawings, models, prototypes, accessories or cases produced at the Customer’s request.
Any reproduction or use of said photographs, presentations, studies, drawings, models, prototypes and logos without the express prior written permission on any medium whatsoever is strictly prohibited.
Maison Artaner Paris retains all intellectual property rights relating to the creations made during its services, including when the creation is personalized by the customer and / or made according to his specifications and this under the conditions defined by the laws and regulations in force.
Intellectual property also applies to copyrighted designs and models which are the property of Maison Artaner Paris.
For any special or tailor-made product requests, Artaner Paris uses its own sketches and the Client must commit to only suggesting drawings which do not constitute a violation of the intellectual property rights of third parties.
Article.11 Privacy policy
The terms of the confidentiality policy that appear below are intended to set out the methods of processing personal information collected during the Customer's visit to the www.artanerparis.com. online store.
In accordance with the provisions of the Data Protection Act n ° 2014-344 of 03/17/2014, the online store www.artanerparis.com has been registered with the CNIL (Commission Nationale Informatique et Libertés) under the number 2003967v0.
All Customer account information is only used in the context of their commercial relationship with www.artanerparis.com. This information is not resold or in no way shared with third parties.
Banking information is never in the possession of Artaner Paris.Transactions are fully processed by Paypal, by bank transfer or via the secure payment module of our 3D Secure partner of Société Générale.
11.1 Right to access and modify personal data
In accordance with the Data Protection Act, the Client has the right to question, access, rectify and delete personal data. The customer can make a request by sending an e-mail to: contact@artanerparis.com specifying a name, first name and address.
11.2 Personal data and cookies
Artaner Paris reserves the right to collect data on the Client through the use of cookies, in order to improve the personalised service intended for the Client.
Upon creating an account, the Customer must ensure the secrecy and security of the password, as well as access to his account. Maison Artaner Paris cannot be held responsible for any fraudulent use of the Customer’s account.
Article.12 Force majeure
Artaner Paris cannot be held liable for total or partial non-compliance with the obligations of these General Conditions. In the event of an event of force majeure as referred to in article 1148 of the Civil Code (war, riots, insurrection, social unrest, strikes of all kind, pandemic...)
Artaner Paris will notify the Customer by e-mail of any event impedes the correct execution of the order and the Customer will be able to cancel said order. The refund will be made under the conditions set out in Article 7 of the general conditions of sale.
Article.13 Availability of the online store
Availability of the online store The online store is accessible to all, 24 hours a day, 7 days a week, except during maintenance work, authorized by Maison Artaner Paris and its service providers.
Maison Artaner Paris cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, especially a service breakdown, an external intrusion or the presence of computer viruses, or any fact qualified as force majeure, in accordance with the law and jurisprudence.
Article.14 Applicable Law - Competent Jurisdiction
The sale of Items on the online store www.artanerparis.com is subject to French law. In the event of a dispute, the Client and Maison Artaner Paris may resort to conventional mediation (consumer association or other organisations of their choice). Any dispute relating to the interpretation of the T & Cs, to the execution or termination of a sale, will be submitted, in the absence of an amicable agreement, to the legally competent courts.
